The U.S. Department of Justice is now threatening to sue the State of Texas over Gov. Abbott's barricade of the Rio Grande. Once again I'm not entitled to any "told you so-s" because the unconstitutional nature of Abbott's actions is so blindingly obvious.

Performance politics. The cruelty pleases some people, provided it is directed at "those" people.

The TX governor should remove the barrier. These are dangerous and can be death traps to migrants.

This is latest in a prolonged battle over border policies between Republican governors and the Biden administration as a show of protest against federal immigration policies.
And because elections are approaching and in states like TX, FL etc this is one of the GOP major issues that people will be held accountable for.

The situation on borders seems to be improving in comparison to previous years. The Governors should work safely and legally in addressing the
    what they call border crisis.
Whats next? Mines on the borders, like in the Iron Curtain, Soviets heavily fortified its side of the border with fences, guard towers, and land mines.

Or, more direct, it is another state-sanctioned effort to commit violence against brown people. Certain voters like that.

Red meat to the Base. Illegal? Doesn't matter. Inhumane and dangerous? Doesn't matter. Counterproductive? Doesn't matter. Pleases the Hard Right neo fascists? That matters.

Governor Abbott says See you in Court. He's being an idiot at taxpayer expense. A preliminary injunction will likely be issued within the next couple of weeks.

He's being a legal idiot because he doesn't care about taxpayer expense. He's playing for the political cover of being able to blame it all on the "bad" judges that will rule against him.

Didn't he take an oath of office?

Yes, but I doubt he considers that oath when making these decisions. The reason I conclude that is that not only is he a lawyer but, he was on the Texas Supreme Court from 1996 to 2001. So, I'm sure he has a good handle on what the law requires and when he might sidestep the law and still personally avoid any legal ramifications.

So the feds sued. They meant what they said.

Annnnd...Mexico has filed a diplomatic protest. Of course they did. The Rio is an international border and what one side does is alway of concern to the other side. That's WHY the Rio is under exclusive federal jurisdiction.

Well Greg Abbott is a Republican governor. He doesn't have to listen to no stinking diplomatic protests!

Now when the federal courts tell him he has to remove his floating hazards, he better listen to them though. :p

    Why?

Alabama isn't listening to Supreme Court's ruling on their gerrymandering. I'm sensing a groundswell of nullification efforts coming. There is a group of people in this country who would simply throw it all away than to see it continue in the direction they dread.

Excellent question, maybe Nosborne can give us some of his thoughts on that one?

I know I'd like to read them.

Maybe they should be required reading for Republican Governor of Alabama, Kay Ivey.

Contempt of Court. We saw a lot of that during the Civil Rights movement. You wouldn't lock Abbott up, that's a lovely thought but unnecessary. No, you fine him personally so much per day until he complies. It works.

Don't defy any Judge at any level unless you are prepared to suffer major personal damage. I came close once or twice but I never actually needed to do it. But consider. As a state Magistrate I could toss you in jail or fine you a thousand dollars per violation if you defied my orders. Not a few criminal defendants found that out the hard way though I didn't need to find contempt for them. The Rules gave me easier ways to enforce my orders.

The contempt power of a Federal District Judge is vastly greater than my authority.

I respectfully suggest Ms. Ivey, Governor of Alabama, Mr. DeSantis, Governor of Florida and Mr. Abbott, Governor of Texas, heed Judge Nosborne's wise -and patient- counsel. The next judge might not be so patient.
