Presidential Succession question

    I cannot find the answer to this……

    If the current President loses the election, on Nov 5th, and Trump wins……..but Biden died a few days later, who would be sworn in as President?

    The one just elected? Would they just swear him in immediately?

    or

    Would they swear in Harris and then Trump in January?

    The Vice President becomes President upon the death of the sitting president. The President-elect would take office on January 20th, as scheduled.

    Unless the Supreme Court decides the President has immunity for everything, in which case Harris will not relinquish her brief presidency to trump. She can refuse to hand it over and call for an insurrection secure in the knowledge that she cannot be prosecuted for it

    Supposed to get a ruling today. I'm going to guess that immunity applies to official acts only and that the President has no official role in a presidential election. That's what they should do but who knows.
