DoJ agrees with me

    The U.S. Dept of Justice is involving itself in a suit against the Florida state government over the anti Asian real estate law. Their arguments are the same as those I posted elsewhere which is no surprise since they're really obvious. Now it seems to me that in signing such a bill into law DeSantis violated his oath of office to support the U.S. (and Florida) constitutions. The man really is a schtinker.

    There is little doubt in my mind that DeSantis has fully embraced the idea that minorities in all forms are best attacked and belittled to try to gain political advantage in an us versus them way. Back in 2012 Republican leadership thought it best to abandon that long held position since whites are expected to eventually become a minority. But, Trump came along in 2016 and doubled down on it. It appears that the Republican party will be playing that game for the foreseeable future. So instead of accepting minorities the Republican party is trying to choose the voters as best they can.

    If DeSantis was under magnifying glass now that he is running to be GOP Presidential candidate he is under microscope and we can expect that pressure will only increase.
    Indeed the law in it current version is discriminating.

    Some rational from DeSantis:
    “Florida is taking action to stand against the United States’ greatest geopolitical threat – the Chinese Communist party,” DeSantis said.
    The bill scheduled to go into effect today on 1 July.

    The bill also restricts foreign citizens of other countries from buying land under certain circumstances. Russian, Iranian, Cuban, Syrian, North Korean and Venezuelan citizens are not allowed to purchase land within 10 miles of military bases under the measure but can still buy property elsewhere in Florida
    The bills prevent anyone working within the governments of those countries, mainly China and agents of the Chinese Communist Party, from buying Florida farmland and any property within 10 miles of a critical infrastructure facility, like seaports and airports, or a military base.
    Advocacy groups fear the language used in the new laws is too vague and could prevent more than just foreign investors and governments from buying up sunshine state property.

    So I think the bill will be modified as activities to block it will increase, and less discriminating and restricting bill will be introduced.

    I think Gov DeSantis and his team will have to work with legal experts, law professionals to propose a better law that protects US Citizens and residents while addressing the potential national security concerns.

    I'm far from being law professional, I remeber previous challenges such as Patriot act.
    Constitutionality was questioned at the time.

    So at hearth I think there is a national security concern. I don't think there is intentional racial motive but valid security concern yet I see red light in the laws current form. I didn't read all the details so my view is non professional.
    So my 2c is for Gov DeSantis to work with experts.
    It would be interesting to review an existing threat, where owner of land is CCP member owns land near military or other sensitive facility.

    National security is not DeSantis’ business. Even if it were, the statute is still illegal.

    My guess is that DeSantis knows that some of his laws are unconstitutional. He just doesn't care. He figures that by the time the court system overturns them it will be past the election or at least the primaries. If not it will just be something else to campaign against.

    DeSantis is a a lawyer. As a matter of fact he graduated with honors from Harvard University for his law degree. He is a legal expert. He knows what he's doing when it comes to the law.

    Who says what he is doing has anything to do with the law? To paraphrase, politics is halfway around the world while the law is still putting on its pants. To wit: Trump, Donald J.

    I definitely agree that DeSantis is concerned with politics not the law. To directly answer your question, it was Learner that was asserting that DeSantis was trying to get the law correct and that he needed to consult with some experts on the law.

    I do think that your response is much more clear and direct than mine though.

    I think the attempt to address State security /National security issue is valid.
    I think the approach and the proposed law is wrong.
    I think the issue is important but the law has to be constitutional, non discriminating.

    Ofcorse when Governor and his team pass law for thir state, it has to do with Law and its political especially during elections season.

    I suggested that since the law is unconstitutional then they need to work with law experts to change it but stay the course to address the security concerns the right way.

    The issue is not new, there are on going issues with such activities.

    Yes. Biden who is "President" not "Governor".

    Meanwhile Greg Abbott is sinking bouyed nets in the Rio Grande the "guard the border". Watch. He'll be pulling them out again within two weeks. Borders, like international relations in general, are federal business. Exclusive federal business.

    I'm far from being an expert.
    I always though that Governor is also responsible for their state security.

    In Florida they have FDLE etc.

    The head of the department is the Governor and Florida Cabinet (Attorney General, Chief Financial Officer and Commissioner of Agriculture). The Commissioner (Executive Director) is appointed by the Governor, with approval from the Cabinet, and confirmed by the Florida Senate. View FDLE's organizational structure.

    Again, I don't have any expertise on these issues.

    The national border is the sole responsibility of the federal government. period.

    Then Gov DeSantis needs to work with President Biden admin to address the issues in Florida State. Especially as we know this type of concerns been addressed by Pres Biden.

    But I don't see this as national border issue.
    More like State Security and National Security issues that may partly overlap with border security.
