Maryland becomes first state to close the so-called 90-10 loophole

Under a measure passed by the Maryland House of Delegates, military benefits would count toward the 90 percent federal funding maximum. It would also begin barring for-profits that receive more than 90 percent of their revenue from federal funds, including military benefits, from enrolling Maryland residents.

BREAKING... On May 7, 2020 The Maryland SB 294, the Veterans Education Protection Act, became law. This historic achievement makes Maryland the first state in the nation to protect veterans by closing the 90/10 loophole for all private for-profit schools in the state.

It took a decade of our advocacy but we finally got it done! The House of Representatives approved the loophole closure on March 10, 2021, following the Senate’s bipartisan agreement on March 6, 2021, to close the loophole while delaying its implementation.

The new rules go into effect on Jan. 1, 2023, but could be delayed until the fall 2023 semester for some schools whose fiscal calendar has already begun.
