The Alabama Supreme Court declared that frozen embryos are "children" in Alabama and that anyone causes or permits such an embryo to die is civilly liable for wrongful death. The Alabama Legislature and Governor swiftly acted to give "immunity" to IVF providers. The more I think about this, the more I think it's legally unworkable. I have a hard time seeing how the Legislature can permit some "children" to get deliberately killed as necessary for some IVF treatment regimens. Those cryogenic "children" have a Constitutional right under a state law to life. I don't see how the Legislature can ignore that right in IVF cases but enforce it in general abortion practice. No one has sued yet as far as I know.
