Fake Indian Degree taking American Jobs

    I live in a very small town in the middle of nowhere. One night, last week, I was driving home late. It's dark. No traffic. I mean none. I hit the one red light going into town. I stop. I look. I run the light. I broke the law. I did it deliberately. I should be fined but that's not going to happen. There will be no consequences because this scenario is inconsequential. Like yours.

    Nothing will happen to my career. I have been through 3 economic recessions and many mass layoffs. Did not loose my job once. My qualifications and experience will get me a good job anytime. I keep myself updated on a daily basis. Somebody need to start this process of identifying illegal workers from India and get them deported. I will do my best and leave rest to others to take responsibility and cleanup this Illegal worker mess. Last night i have drafted a letter to USCIS and the local senators to take action. I have also requested to keep my name anonymous. I will be really happy if those 12 are deported. It will be a good beginning.

    My company no longer sponsors H1 visas.
    From what the Indian guys tell me, H1 visas were always supposed to be hard to get but over the last 10 years the government didn't enforce the standards to the letter of the law. Now they are so visas are being denied left and right. I think its something like there is a limit to the amount of indirection now where there was not before. Before you could work for a company that works for a company that places you at an American company. Now its gotta be much more direct. Ask someone from India and they will tell you the stories about how some of their friends got rich by just creating shell companies to launder visas for other Indians back in the dotcom boom.

    I have also heard stories about uneducated Indian housewives making money from their kitchen "selling" H1B's to different companies across USA. We need to put an end to this madness. There is no shortage of Labor. In reality there is shortage of Cheap/half-educated/resume faking labor that's what it is.

    Your Indian friend is only partially correct.

    USCIS always maintained that a proper 'Employer-Employee relationship" should exist in H1B cases. What changed recently was their interpretation of it.

    Before, USCIS used to consider Pay-stubs and W-2 forms as a proof of Employer-Employee relationship. Starting 2010, they changed their interpretation (google for "uscis neufeld memo h1b"). They are now more serious now about third-party placements, and need more proof that the original H1B sponsoring employer has complete control over the foreign worker's employment, including the rights to hire, fire and control his daily work activities. .

    Yeah that makes sense. These guys that hire and sponsor the Indian programmers have zero control over their day to day activities. They are just recruiters.

    I have not only heard but have seen this madness. It looks like you support these illegal practices.

    You missed the whole point. I am not here to support any fraud activities or malpractices. All I am trying to say is that there are lot of restrictions on H1B employment right now - so it's not just "laundering" visas and jobs any more. It might have happened in the past, but it's not not just that easy anymore - and it's a good thing.

    1. Have we cleared up the difference between fake and unaccredited?
    The lab tech program at FORTIS is unaccredited but the school is not fake.

    2. Stop snitching.
