This particular Supreme Court is inclined to support states rights.

    Mark,

My "best solution" was in reference to the unlikely event that congress ever got involved in this problem, which I predicted they wouldn't, and shouldn't.

Could congress restrict the term "degree" without a constitutional amendment? I'm not sure, but I do know congress and the various state legislatures have restricted quite a few words: "Medical Doctor", "Sugar Free", "Building Contractor", etc.
For each of these terms the governing body has created specific standards. Could they not create a standard for higher education? But that is were the trouble begins. Congress would have to determine a standard, which I don't believe they could do.

    AlnEstn:

I know very little about Bob Jones University, so I don't know wether it fits into my comment or not. I do know of a number of unaccredited "Bible Colleges" who issue B,M,Phd, etc. with little relationship to academic standards. It would be my concern that conservative members of congress, whose support derives from members of churches who sponser these schools, would be tempted to include them in a federal standard.

Except, apparently, where it has to do with presidential elections. In that case, they get to decide what is best for us.

Does anyone honestly think Al Gore would have done so well after 9/11? I never liked the Supreme Court, by the way. Think it should either be abolished or the judges should have term limits or the people should vote on the justices.

Although often ignored, the 10th Amendment of the U.S. Constituion is pretty clear in what powers the federal government does and does not have:

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people. "

Regulation of education is not specified in the Constitution. Therefore, it should be left to the states or to the people.
