Today the First Circuit Court of the State of Hawaii granted a request by the Office of Consumer Protection to enter a default judgment against Charles James dba Marlborough University. The court ordered the mail forwarding service utilized by Mr. James to cease providing services. It also ordered the termination and cancellation of its tradename registration. The court ordered Mr. James to provide restitution to any consumer requesting it within twenty days. Finally the court imposed a civil penalty of $250,000.00 against Mr. James personally. This is good news. I continue to be impressed with the work of Mr. Brunton and the Office of Consumer Protection. I predict that very shortly, Hawaii's reputation for being a haven for less than wonderful schools will be a memory. Bruce
I suppose there are 100s, even 1000s, of Charles Jameses in the world. But Charles James is also the name of a very famous couturier. The name is famous enough in certain circles that that name alone could or should set off alarm bells and make one question whether it is simply a pseudonym.

Please advise, Is there any way that such simple and huharming people can get their fees they had paid to them. In their prospectus they caimed to be registered with the Dept. of Commerce and Consumer Affairs in the State of Hawaii USA in accordance with the Provisions of Chapter 482 of the Hawaii Revised statues Certificate of Registeration No:209260 The explaination given by Mr. Brunton was read by me today. On October 29, the First Circuit Court of the State of Hawaii signed and filed (1) Findings of Fact and Conclusions of Law and (a)a Default Judgment against Mr. Charles James dba Marlborough Univ. Mr. James is believed to be a resident of either Gibraltar or Bangkok, Thailand. The judgment enjoins Mr. James from operating any unaccredited degree granting institution. It also imposes $250,000.00 in civil penalties against him personally. In addition, the judgment obligates Mr. James to provide ful restitution to any student or graduate of Marlborough University who so desires. There is no formal process required. Consumers are directed to simply write the University and insist on a refund. Consumers can also file complaints with our office. Complaint forms are available on the internet at http://www.state.hi.us/dcca/ocp. The order requires him to make the refund within twenty days of the request. Mr. James operated this institution entirely from outside the state of Hawaii. There are no known assets within the state (or even in the United States) from which the judgment may be collected. Thus in the event Mr. James refuses to pay restitution, there is little our office can do. The judgment, however, does order his mail forwarding/voice mail service here in Hawaii to terminate their services. The judgment also requires the state to terminate the tradename registration for Marlborough. In short, this judgment makes it clear that Marlborough University is not authorized to issue degrees in or from the State of Hawaii or under the claimed color of Hawaii law. The Honolulu mail-forwarding service utilized by Marlborough's owner, Mr. Charles James, has been ordered to cease providing services and has done so. Marlborough's website has been taken down. The last known address for Mr. James is Apartado 1020, Portimao 8501-920, Portugal. Portugal's Ministerio de Educacao has been notified of his activities. Mr. James has utilized a facsimile machine with a number in the State of Washington. Washington's authorities have been notified. Marlborough's last address was 24 College Lane, Gibraltar. Gibraltar's authorities have been notified. There are no known assets within the State of Hawaii which can be utilized to satisfy the judgment, thus there is nothing further that can be done.
