Pardon me if someone has already addressed this. If the US federal government no longer recognizes a distinction between nationally-accredited and regionally-accredited colleges and universities, and the two-tier system of accreditation is officially abolished, why are some of the foreign credential evaluators still evaluating ENEB's degrees as "not regionally-accredited"?

For example, on the other forum's ENEB wiki it was reported that the FCE Joseph Silny & Associates performed a course-by-course evaluation of an ENEB master's degree and deemed it a "master's degree (not regionally accredited)". But, does that even hold any water now?

If I was someone interested in doing a traditional doctorate program I'd get a Joseph Silny & Associates evaluation, submit the evaluation report as part of my application, and include a statement in the application (with links to official government documentation online) respectfully noting the change in policy. If my degree was awarded with distinction I'd include that letter in my application as well. Then I'd see what happened.

Lastly, could the FCEs be leaving themselves open to lawsuits for continuing to perpetuate a distinction that the government abolished?
