    Voluntary Agreement Letter

    To All Impacted Educational Institutions:

    The provisions of Assembly Bill 1525 have recently been enacted as Chapter 67, Statutes of 2007. As permitted by the applicable provisions of this recently enacted statute, agreements are being tendered to those institutions that had a valid approval to operate or authorization pursuant to Section 94905 of the Education Code, as it existed on June 30, 2007, for the purpose of ensuring continued student protection after the Private Postsecondary and Vocational Education Reform Act became inoperative. (Chapter 7 (commencing with Section 94700) of Part 59 of Division 10 of Title 3 of the Education Code, as it existed on June 30, 2007).

    The enclosed proposed agreement is being tendered to your educational institution to provide your institution with the opportunity to enter into a voluntary agreement with the Director of the Department of Consumer Affairs. The agreement would apply retroactively to July 1, 2007. The agreement would require your institution to comply with California statutes, rules, and regulations pertaining to private postsecondary educational institutions or pertaining to non-WASC regionally accredited institutions as defined in Section 94740.5 of the Education Code, as it existed on June 30, 2007, in effect as of the close of business on June 30, 2007. The purpose of this agreement is to provide your educational institution with a legal method by which the institution may comply with applicable federal statutes, rules, and regulations from July 1, 2007, to January 31, 2008, inclusive, and demonstrate to the United States Department of Education the legal authorization to operate schools under California law from July 1, 2007, to January 31, 2008, inclusive.

    If your institution wishes to enter into such an agreement, please complete and sign the applicable provisions in the agreement for each location approved as of June 30, 2007 by the Bureau for Private Postsecondary and Vocational Education (Bureau) and submit it to the Department of Consumer Affairs, Attention: BPPVE Voluntary Agreements, P.O. Box 980818, West Sacramento, CA 95798-0818. If accepting the voluntary agreement, you must submit to the Department of Consumer Affairs an executed agreement within 15 days of receipt. Each institution must, within 60 days of the operative date of AB 1525 (July 12, 2007), disclose to all its current and prospective students whether it has agreed to or declined to enter into the tendered agreement enclosed. A list of schools that have entered into voluntary agreements with the Director will be posted on the former Bureau’s Web site at www.bppve.ca.gov.

    Voluntary Agreement for an Educational Institution
    Under the authority vested in the Director of the Department of Consumer Affairs (“Director”) by Chapter 67 of the Statutes of 2007, the Director hereby enters into an agreement with the below-named educational institution. The below-named private postsecondary educational institution hereby agrees to comply with all of the following: state statutes, rules, and regulations pertaining to a private postsecondary institution or pertaining to a non-WASC regionally accredited institution as defined in Section 94740.5 of the Education Code, as it existed on June 30, 2007, in effect as of the close of business on June 30, 2007, that had a valid approval to operate or authorization pursuant to Section 94905 of the Education Code, as it existed on June 30, 2007, for the purpose of ensuring continued student protection after Chapter 7 (commencing with Section 94700) of Part 59 of Division 10 of Title 3 of the Education Code became inoperative. If executed timely, this agreement shall be effective retroactive to July 1, 2007.
