I'm not just trying to be contrary. But there is a difference between establishing judicial precedent that this is a thing that, according to rule of law, is now going to be interpreted this way versus "cost to settle is cheaper than cost to litigate, here's a check."
That may be one interpretation but another is "Hey, I'm not sure we can win this so maybe we ought to settle and try to get out cheap." From the perspective of the student, they have "won" and probably care little for legal precedent. This win will encourage others to follow suit. Eventually it will wind up in court because someone won't settle. It's all just part of the process.
