I'm not a lawyer, but I think they're going to have a hard time with the wrongful death aspect. If half of what the families are saying is true, then the defamation may be a winner, but they filed it far too late to have it heard before the election. If Hillary wins, she can't be sued while in office.

I don't think becoming President causes pending lawsuits against you to just drop off. If it does then Trump stands to get out of a whole bunch of trouble if he wins.

But defamation in really hard to prove in this country so it's kind of an uphill battle. The wrongful death piece, I imagine, is going to get dismissed anyway because of the Federal Employees Liability Reform and Tort Compensation Act of 1988. The defamation, depending upon which public statements they are referring to, may have been made after she left office. So those wouldn't be as big of an issue.

But the lawsuit seems to allege not just that she didn't beef up embassy security but that she emailed information about the ambassador which was intercepted and given to Islamic terrorists who used that information to kill the ambassador. That's a whole lot of reaching.

Right. It doesn't. From that great law resource, Wikipedia:

"Clinton v. Jones, 520 U.S. 681 (1997), was a landmark United States Supreme Court case establishing that a sitting President of the United States has no immunity from civil law litigation against him or her, for acts done before taking office and unrelated to the office."

    It's here: https://en.wikipedia.org/wiki/Clinton_v._Jones
