The State of Hawaii has settled the pending litigation against Steven W. Moss, the owner and operator of the former Prescott College of Business & Leadership Studies. The settlement is documented by a Stipulated Permanent Injunction and Final Judgment which was filed with the First Circuit Court of the State of Hawaii on March 7, 2002. Under the terms of the settlement, Mr. Moss is enjoined from operation of any unaccredited degree granting insitutions in, from or under the claimed authority of Hawaii and its laws. Mr. Moss has also agreed to offer full restitution to all Prescott graduates and students and to pay a civil penalty of $100,000. A default judgment against The Prescott Group, Inc. was entered previously in the case and is still in effect. It contained substantially similar terms, although the civil penalty against the corporation was $500,000. No payments have been made and, under Hawaii law, it is the responsibility of the party holding the judgment to collect it. Since there are no known assets located within the state of Hawaii, the judgments will have to be registered in the states in which assets are found.
