    Guaranteed student loans cannot be discharged in bankruptcy. Defaulting can result in having your tax refund taken as payment for your student loans. The most you will be able to do if you are in dire straits financially is apply for a hardship deferment.

    The only exception I've ever heard of for completely discharging a student loan was an individual who was seriously injured in an automobile accident and was permanently disabled to the point they could not work.

    Regarding collection efforts, I saw a big increase in the number of garnishments that had arrived in my Payroll Department in the past 5 or so years prior to my retirement. The Payroll Manager who worked for me used to get upset with these employees. She always talked about how her and her husband scrimped and worked hard to pay their student loans while these other deadbeats just walk away. Of course the student loan folks caught up with them and the garnishments typically required a higher repayment amount than if they had worked with the loan company directly.

    Now that I'm teaching full-time, I cringe when I see these students who have student loans, collect their stipend check, and blow the money on foolish stuff like cell phones, fast food, etc. I always warn my students that have these loans, to remember that they must repay the loans when they leave school.

    There is a federal regulation (called the "90/10 rule") that no school can allow their tuition revenue to comprise of more than 90% in federal student loans. In other words, they have to collect at least 10% of their revenue from other sources (VA, cash, etc.)

    Phoenix and many, many, MANY other schools push this rule to the max. There are many that show up on a 'watch' list every year for exceeding 90%. I've never seen UoP on the watch list, but I'm sure they are more adept at managing and monitoring it than most schools.

    The US Equal Employment Opportunity Commission has filed a lawsuit and is seeking class action status accusing the University of Phoenix of discriminating against non-Mormon employees. The legal action claims employment conditions at the private college were less favorable for those workers in regard to enrollment leads, tuition waiver grants and reprimands. The suit alleges the University of Phoenix discriminated against its employees based on religion.

    For-profit education company Apollo Group Inc. said Monday it will pay $67.5 million to the U.S. government to resolve a lawsuit, in addition to $11 million in attorney fees.

    The lawsuit filed in 2003 by two private plaintiffs alleges Apollo's University of Phoenix violated a rule stating that recruiters may be compensated partly for the number of students they enroll, but that cannot be the only factor determining compensation.

    The company said that settling eliminates risks in taking the case to trial and is in the best interests of students, employees and shareholders.

    The lawsuit was filed in U.S. District Court for the Eastern District of California, the Sacramento division.

    "This agreement not only brings closure to a long-running dispute and enables the company to avoid the uncertainty and further expense associated with protracted litigation, it opens the door for a more constructive partnership with our lead regulator, the U.S. Department of Education ," said Charles B. Edelstein, co-chief executive of Apollo Group.
