According to a report issued by the California State Bar, Roger Agajanian, founder and Dean of British American School of Law, has been reinstated as a member of the State Bar.

He resigned from the Bar a number of years ago rather than face a hearing which could have resulted in disbarment. He founded British American after this date. I have been unable to determine the nature of the charges. (You have to pay a fee to get this information.) Does anyone know what he did or didn't do?

According to the newspaper article, he has passed a professional responsibility exam, demonstrated present ability and learning in the general law, and has been rehabilitated and possesses moral qualifications for readmission.

Wouldn't you think the CA Dept of Education would have required the Dean at least be a attorney? Now that he is a lawyer again I wonder if he will continue with the law school.

But all in all, I guess this is good news.

Oh boy. Not good. Only a tiny percentage of lawyers in any jurisdiction is ever subject to formal discipline and it usually is for something rather serious, such as using client funds for oneself, being convicted of a crime, or, very often, refusing to cooperate with the Bar discipline authorities.

Hey, but now Mr. Agajanian becomes one of the few lawyers on earth who has officially been found to have appropriate moral standards.

invest the money to find out what
    the charges were)

Oh gawd, this is bad for the legal profession & its clients *and* for distance learning.

I didn't know about this fellow's background. Does anyone really want him to be a representative of DL???

  6. Here's a 1994 report documenting his suspension from the Bar pending a hearing: http://groups.google.com/groups?selm=2sveek%24hdj%40usenet.INS.CWRU.Edu&output=gplain

And report of his disbarment following resignation: http://groups.google.com/groups?selm=33sqfh%24875%40usenet.INS.CWRU.Edu&output=gplain

This case is quite interesting: http://caselaw.lp.findlaw.com/data2/californiastatecases/s031247.pdf
From a dissenting opinion: "Agajanian’s abysmal across-the-board performance rendered the penalty phase of the trial a complete and utter farce."

Actually, all applicants for the California Bar are required to obtain a favorable moral character determination.

This is the most comprehensive and intrusive investigations I have ever seen.
