The State of Hawaii has settled the pending litigation against the United States Open University and Theron E. Dalton. The settlement is documented by a Stipulated Judgment and Permanent Injunction which was filed with the First Circuit Court of the State of Hawaii on October 2, 2003. Under the terms of the settlement, the defendants are enjoined from further operations of an unaccredited degree granting institution in, from or under the color of Hawaii law and are required to pay $5,000 for civil penalties, attorneys' fees and costs of investigation. Theron E. Dalton is also known as Ted Dalton. He was also president of Newport University, and is still listed as such on some Websites: http://www.newport.com.hk/htm/about/about.htm http://www.geocities.com/kharal_2000/USAINF.HTML The relationship between these Websites and the Newport University Website at http://www.newport.edu is unclear to me. We have litigation pending against AUH. I thought I posted a notice earlier. The case is in its early stage and is currently being transferred from the court in Honolulu to the court in Wailuku, Maui where AUH has its home office.
