Hi, I am sure this may have been discussed before. But I am wondering if someone wants to get employment in US and has a DL degree in Computing/IS/IT from US, Will he qualify for Employment Visa (H1B) and does the same formula applies - 1 year of College/University = 3 years of work experience if someone gets a DL degree say from TESC or Excelsior and completes a degree in 2 years or so (instead of 4 years). In this case would the same formula apply ? Would he be qualified for Employment Visa (H1B) and the degree would be considered a four years degree (Although he has been in College/University program for 2 years and not 4 ) ? Thanks.
etech, I've held 2 H1-B's and a L1, and used the 3 years experience = 1 year study formula for these (I had completed just over a year of formal university schooling at the time). So, I had to make up the missing 3 years with 9 years of practical experience. However, if you have a RA CompSci degree it is my understanding that this is the sole requirement...the experience requirement is not relevant nor required.
To be honest, I don't know, but I suspect the answer is "yes". You should probably check with an immigration attorney or US immigration. I checked out a website - www.h1bvisalaw.com and the the following comes from them: (c) A copy of the alien's U.S. college degree (bachelor's, master's or Ph.D.) and/or foreign degree with evidence that it is equivalent which must be evaluated and certified as a education equivalency to a U.S. baccalaureate degree or higher. Evidence of education, specialized training, or experience that is equivalent to a U.S. baccalaureate degree may also be submitted to fulfill this requirement. To determine equivalency to a baccalaureate degree in the specialty, three years of specialized training and/or work experience must be demonstrated for each year of college level education that the alien lacks. To show equivalency to a master's degree, the alien must have a baccalaureate degree and at least five years of progressively responsible experience in the specialty. Note that it states a copy of the US college degree. It seems likely that with a bachelor's in an IT discipline along with relevant experience you shouldn't have any trouble, but again, check it out with someone qualified to give you a definite answer.
