    I have a great idea for a new school:

    Yes, "a school" that teaches ecology, outdoor recreation, leadership, or conservation is completely exempt from even the minimal standards required by the state of Wyoming. (See the link above.)

    Perhaps the marketing campaign could be: "Why bother with a degree from Kennedy-Western when a degree from the WEI is just as valid."

    Hi Jeff (or should I say Chancellor Hampton?) -
    I think this sounds great except I'd like my doctorate to be in the area of Eco-Psychology. Can we "arrange" that? Also, I only want this degree if the diploma is written in Latin with some really nice gothic font and maybe a gold seal in the corner. Oh, and by the way, cost is a bit of a factor for me so can we keep it down to maybe the $25-$50 range. Thanks so much, now I can feel really good about myself.

    Jack,

    I don't think the Eco-Psychology degree would be a problem. The law states that "a school that teaches ecology, outdoor recreation, leadership, or conservation" is exempt. It doesn't say that those are the ONLY areas that the school can teach in.

    As far as the cost, that will depend on the GPA you would like to "earn."

    While a court could interpret the statute in the manner it was probably intended, the "school" could possibly win at the appellate level. Many appellate judges don’t like sloppy drafting and might force the legislature to amend the Article if they want enforcement.

    It’s also possible the legislative history will show the legislature intended only a limited exemption and the Courts could use this as a basis to find the school in violation. But this type of drafting is what attorneys live for.

    I find it groundbreaking and original that Wyoming schools have the creativity to add new words to the English language, kindof like Shakespeare did, you know?

    WEIRD degrees

    The Wyoming Ecology Institute has officially changed it's name to reflect recent changes in its mission. The school is now known as:

    Wyoming Ecology Institute for Research and Development.

    We are the only school in the world to legally offer WEIRD degrees.



    I suspect that the law was written to provide an exemption for ONE specific school. This is an all-too-common practice in the drafting of legislation, but it is usually done in such a way that although it does not specifiy the one entity, it is not possible for another entity to fit the definition (i.e. a school that has taught ecology since 1981 and is located in a town with a 1990 census population of between 22,000 and 23,000.)

    Anyway, the way the law is written, I think that if a school ONLY taught in the areas that are specified, it would be hard to argue against the exemption. Legislative intent is only relevant when the legislative language is not clear.

    Wyoming probably did mean this to apply to one specific school or at the most to a very few. The way 21-2-406 is written is too loose. It takes away from 401-405. I would prefer to see 401-405 apply to all Wyoming Approved Schools. I like flexibility, but it is very difficult to make a rubber band stand up. 406 is, in my view, a rubber band.
