Hawaii Litigation Update: Univ of Advanced Research

    On September 23, 2004 the First Circuit Court of the State of Hawaii entered a summary judgment against the University of Advanced Research-Hawaii Campus, Ltd. (a Hawaii corp) and Frederick A. Mitchell (a California resident).

    Under the terms of the judgment, the Business Registration Division is required to terminate UAR's corporate existence.
    UAR and Mitchell are enjoined from operating any degree granting institution in, from or under the color of Hawaii law. They are also required to implement a program offering restitution to any students or graduates who enrolled or graduated subsequent to July 1, 1999. The court also imposed civil penalties of $125,000 against each of them.

    At the time, the summary judgment was not final because of the filing of a counterclaim against the State of Hawaii by Frederick Mitchell. That counterclaim was dismissed yesterday, hence the judgment is now final. UAR has no known assets within the state of Hawaii, hence the judgment is currently deemed uncollectible.

    Even as Samuel hewed Agag in pieces before the Lord at Gilgal, so Brunton hewed UAR in pieces before the court at Honolulu.
