North Dak. law and degrees from unaccredited schools.

    Does anyone have any knowledge of or information about North Dakota's law with regards to use of a degree from an unaccredited institution in that state? I thought I had read something (don't recall where) that stated that if the school is a candidate for accreditation then the degree from that school could be legally used in N.D.

    Thanks for providing that link. It appears very clear from the wording of the statute that a degree from an institution that is currently an applicant for accreditation is legal for use in North Dakota. This also indicates that individuals with degrees from any of the current DETC applicants for accreditation could legally use such a degree in N.D. IMHO.

    What about south Dakota and Montana? I would like to know the law with regards to use of a degree from an unaccredited institution in that states

    Neither South Dakota nor Montana have laws prohibiting the use of an unaccredited degree.

    If neither south dakota nor montana have no laws on unaccredited colleges/universities operating on those states, would it be fair to assume that in the case of Fairfax University in Louisiana which is registered as religious institution in that state, but also offers non religious degrees as well and having offices/campus in South dakota and montana, would that be there degree granting authority come from either SD or Montana for non religious degrees?

    Any thoughts?

    Let me see if I can take this one - someone please straighten me out if I'm wrong.

    First, the law under discussion is: Can you USE an unaccredited degree in those states. So, if you live in either SD or Montana, then you can claim to hold a degree from pretty much any real or fake school you want.

    Fairfax is based in Louisiana, so they must follow the laws of that state, which state that schools must be accredited or pursuing accreditation. That is, generally, where the authority to grant degrees comes from (Rich/Dr Bear/someone, I'm not way off am I? I don't have my BG right here.)

    Except, Migara, that Fairfax tells Louisiana they only give out religious degrees, so they don't need state approval. Louisiana takes their word for it, and says that Fairfax doesn't need state approval - for ANY degrees.

    What's this add up to? Here's the best way to put it, I think: The only degree-granting authority that Fairfax has is that Fairfax says they can grant degrees. That's it. The school gave the authority to themselves, all based on their claim to be a religious school.
